too much history not enough procedure

The problem with this book is its over treatment of historical issues surrounding how American Civil Procedure comes about and changes through time rather than being a good case book with critical analysis on what the court has done, how their decisions effect people and of course Civil Procedure. Perhaps the most telling is the poor treatment of Pennoyer v Neff, where the case is not even included but only excerpts and then some summary by a historian. This was unhelpful. Though it may be good to shorten or remove some parts of the case, it has been done so excessively here that it is hard to take what is so important about Pennoyer for Civ Pro students.
